Court orders JZ to reconsider magistrates’ salaries


The North Gauteng High Court has ordered President Jacob Zuma to take a fresh look at the salaries paid to South Africa’s regional magistrates and regional court presidents. 03 September 2012 | ILSE DE LANGE PRETORIA - Judge Eberhard Bertelsmann yesterday set aside Zuma’s decision to increase their salaries by only 5% for 2010/2011. He referred the matter back to Zuma for reconsideration, but ordered that the salary increases would meanwhile remain in force until a new decision was made. The court order follows an application by the Association of Regional Magistrates of Southern Africa. The magistrates maintained government’s one-size-fits-all approach to salary increases for all public servants was unfair and did not take their particular circumstances into account. They complained that regional magistrates had the lowest retirement benefits of all public office bearers and had received lower salary increases than public servants over the previous years. To ensure the independence of the judiciary, judicial officers are not allowed to negotiate directly with the executive or to resort to industrial action if they are dissatisfied with their salaries. Judge Bertelsman said it was common cause that regional courts formed the backbone of the criminal justice system in the Republic and that magistrates faced many challenges. It appeared to be common cause that they were insufficiently recompensed considering their position. He said there was no evidence of any appreciation that the circumstances of regional magistrates might require a salary adjustment that differed from that of other categories of office bearers. He concluded that Zuma’s determination of their 2010 salary adjustments was unlawful and irrational because of his failure to consider their particular role, status, function, duties and responsibilities prior to making a decision. A further court application by the regional magistrates and lower court magistrates about their 2011 salary increases is pending. - The citizen - Comments by Sonny The unjust salary scales in SA tells an unfair story of injustices! HRC welcomes steps to ensure Info Bill complies with the constitution


The SA Human Rights Commission welcomed the steps taken by Parliament to ensure the Protection of State Information Bill does not violate the constitution. 04 September 2012 | Citizen Reporter The commission has made numerous objections to the Bill and has stressed the supremacy of the Promotion of Access to Information Act as the enabling law that gives effect to the right of access to information. Deputy chairman of the commission, Pregs Govender, said the right of access to information is necessary for the fight against corruption and poverty. “We live in a society where the constitution upholds our right to in formation. Many communities feel they are left-out of government’s service delivery planning. “Against the backdrop of poverty, lack of efficient service delivery and corruption, we need to equip communities to assert their rights and confront a non-responsive government.” The National Council of Provinces met to de liberate on the Bill last week as it entered into the final stages for passage into law. The commission therefore called for the review of the Bill to in corporate earlier sub missions that have already been made to Parliament. Central to the concerns expressed by the commission in its sub missions were the impact of the Bill on freedom of expression, access to information, the lack of a reasonable publication defence and the inadequate protection for whistleblowers. Govender added: “It is important that the modest successes recorded in the 12 years of access to information practiced in South Africa are not eroded by the passage of a defective Protection of State Information Bill!" The trial of two men accused of vandalising a painting depicting President Jacob Zuma with his genitals exposed was postponed by the Hillbrow Magistrate's Court on Tuesday. 04 September 2012 | Sapa Barend la Grange, 58, and Louis Mabokela, 25, are accused of defacing artist Brett Murray's painting "The Spear" at the Goodman Gallery on May 22, by smearing it with red and black paint. The matter was postponed to October 2, as agreed by the State and the defence, for the accused to make representations to the director of public prosecutions and the Goodman Gallery on why the charges should be dropped. The outcome of this would be given at their next appearance. They are charged with malicious damage to property. Both men's bail was extended. Outside the court a handful of protesters gathered in support of Mabokela. Dressed in African National Congress T-shirts, they sang and danced. They carried placards, one of which read: "We salute Louis and (President Jacob) Zuma". Among the group were Mabokela and his uncle Stephen Sefofa. Mabokela said he wanted the charges dropped. "I want to see the charges dropped, because it's an insult... to the nation." Sefofa echoed this, and said children should respect their parents. "There are different ways to express your views. It's an insult." He said they also planned to protest in Cape Town following the release of a similar painting showing Zuma's genitals. After his first court appearance, La Grange said the gallery and the artist had the right to display the painting, but once their point had been made, the painting should have been taken down. "A high court must get involved for a painting? It took me 15 seconds to get rid of the painting," he said. He said his action was a political statement. It was not about art, but rather a political issue which had become a race issue. "It was my spoilt ballot paper," La Grange said. He said he did not know Mabokela and had met him only after they were arrested.


A man has been sentenced to 19 years in jail for murdering his wife, Free State police said on Tuesday. 04 September 2012 | Sapa "On 31 August 2011 at about 11.30am, Morake Joseph Ramaisa brutally murdered his wife, Mamokete Maria Ramaisa. The murder occurred at the couple's house in Riebeeckstad near Welkom," said Sergeant Puleng Motsoeneng. "It is alleged that the couple had an argument that led them to fight." Ramaisa took a knife and slit his wife's throat. She ran into the guest bathroom where she died. The couple's 15-year-old son and 10-year-old daughter were in the house at the time. The boy woke up when he heard his parents arguing. He found his mother lying in a pool of blood in the bathroom and called police. Ramaisa was arrested shortly afterwards and charged with murder. He was sentenced in the Virginia High Court on August 30. The Citizen Comments by Sonny Are all these family murders of late all inspired by the political violence in South Africa? Things like this are out of place in a Democratic society where people learn to live in harmony with each other and debate problems without violent confrontations? Will our youth grow up and accept violence as the norm of society?

Another purpose of the wrapper was to keep the P-38 clean before use. Afterward the used P-38 was expected to be thrown away as more P-38s were packed in with each case of C-Rations. At first a dozen P-38s came with each case but eventually only 3 or 4 were packed in a case because it was found that GIs were keeping the P-38s rather than being without one at chow time (read Rations in Korea note). Unopened P-38s still in the wrapper and still in good condition are getting much harder to find. During the WWII, Korean and Vietnam Wars when hungry GI's were ready to dive into their delicious meals of K or C-Rations they used their trusty P-38s to open the cans. No it wasn't the famous WWII fighter plane or a German pistol, it was an amazingly simple little piece of 1-1/2 inch stamped metal that was developed in just 30 days during the Summer of 1942 by the Subsistence Research Laboratory in Chicago. It's official designation is 'US ARMY POCKET CAN OPENER' or 'OPENER, CAN, HAND, FOLDING, TYPE I', but it is more commonly know by its nickname the P-38 which it supposedly acquired from the 38 Punctures required to open a C-Ration can. It is also known by many as a "John Wayne" by those in the Navy and Marines because he was shown opening a can of C-Rations using a P-38 in a WWII training film. From then on Sailors and Marines referred to them as a "John Wayne". Recently I received emails from two different Vets that referred to P-38s as 'Dead Dukes' after John Wayne's death. Originally P-38s came wrapped in brown Kraft paper packets with a diagram and directions how to use printed on it. About a dozen P-38s came packed in a case of C-Rations but because everyone was hoarding them eventually only 3 were included in a case (read Rations in Korea note). These handy gadgets have adorned the dog tag chains and key rings of WWII, Korean and Vietnam war vets ever since opening their first can of C-rats with one. I've heard stories about GIs holding C-Ration can opening races using P-38s which were usually won by one who could open a C-rat can in less time than it takes to read this sentence. In her famous article for 'The Pentagram' Army Public Affairs' Officer Maj. Renita Foster wrote the defining article about P-38s how they could be the Army's greatest invention ever. Most WWII, Korean and Vietnam era GIs would hardily agree. They are becoming collector's items since more and more GIs are putting them in their military & medal displays, collections and to replace a lost beloved P-38. Also P-38 collections have become very popular lately as they don't cost much and don't take up much space. It's a lot of fun finding the hard to get P-38s. I've had the same US SPEAKER P-38 on my key-ring since my first Boy Scout camping trip when the Scoutmaster gave it to me. We used them to open the big cans of peaches for the delicious cobbler that he would make in a huge cast iron skillet over the campfire. We ate that delicious cobbler as we sat around the campfire just before crawling into our sleeping bags. I can even taste it now. Shelters and organizations that aid the homeless hand them out and they were also included in some of the humanitarian relief packets dropped into Afghanistan. I've also been told they are being handed out here in the USA by relief organizations after natural disasters for when the power is out and electric can openers no longer work. Griekwastad: Saak uitgestel tot 1 Oktober

Daar sal altyd iets wees wat jou lewe beïnvloed.” Gerugte dat die seun vandeesweek die plaas saam met sy regspan besoek het, is nie waar nie, het sy regsverteenwoordigers en die bure wat die sleutels van die plaas hou, gesê. In die borgtogaansoek verlede week het die verdediging gekeer dat ’n lang verklaring van kol. Dick de Waal, provinsiale hoof van die Valke en die speurder wat die moorde ondersoek, asook drie foto-albums oor die moorde in die hof bekend gemaak word, omdat die toelaatbaarheid van alles moontlik betwis kan word. De Waal het gedurende die aansoek om borgtog gesê die ondersoek sal binne weke voltooi wees. ’n Paar verklarings moet nog afgeneem en enkele “los drade vasgemaak word”. Hy het gesê die dossier sal, sodra dit gereed is, aan die verdediging oorhandig word. Adv. J.J. Cloete het gesê die seun sal in die laaste twee weke van die jaar in die hooggeregshof in Kimberley verhoor kan word. De Waal het getuig die polisie se forensiese ondersoek en die insameling van bewysstukke is baie deeglik gedoen. Sowat 72 DNS-toetse en vatmerk-DNS-toetse is gedoen. Uit toetse op ’n geskeurde T-hemp van die seun is spatsels van Marthella se bloed gekry wat op ’n ernstige worsteling dui. Daar is monsters geneem van die seun se naelskraapsels. Die hemp wat hy die aand van die moorde aangehad het, is ook vir kruit getoets. De Waal het getuig die seun het homself die aand van die moorde deurentyd verontskuldig. Hy het krapmerke aan sy nek, bloed aan sy linkerbeen en bloederigheid aan sy ken gehad. Daar is vasgestel dit was Marthella se bloed. Toe die seun ná sy inhegtenisneming van Bloemfontein na Kimberley gebring is, was daar ’n nuusberig daaroor op die motorradio. Die kind het toe geglimlag, het De Waal getuig. Adv. J.J. Dick de Waal, het Vrydag getuig Marthella Steenkamp is vier keer geskiet, onder meer in haar bors. Hy het getuig op die tweede dag van borgaansoek van die minderjarige wat verdink word van die drie moorde op die Steenkamp-gesin. Hy het getuig Christel Steenkamp is in die rug en in die nek geskiet. Deon Steenkamp het wonde aan sy regterskouer, regs aan sy bors en agter sy linkeroor gehad. Hy het getuig die twee vuurwapens waarop beslag gelê is, is waarmee die Steenkamps vermoor is. Dit blyk die oorledenes is met 'n .357 Magnum doodgeskiet voordat 'n .22 gebruik is om "seker te maak". Daar is ook geen "vreemde DNS" op die twee vuurwapens gevind nie. De Waal het gesê meer as 72 DNS-monsters is getoets omdat dit 'n hoëprofiel-saak is. Gewoonlik toets hulle net drie. De Waal het erken dat as die seun op borgtog vrygelaat word, hy glad nie met bewyse of getuies mag inmeng nie. Maar hy het gesê hy staan steeds borgtog teen. Dit was gruwelike moorde en die staat het 'n verantwoordelikheid om die gemeenskap teen sulke mense te beskerm. “Hy het die Steenkamps tereggestel . . . Die verrigtinge het Donderdagoggend dramaties begin met 'n ligte relletjie tussen die staat en verdediging oor die beskuldiging dat die staat 'n dik lêer vol getuienis en 'n groot hoeveelheid inligting eers gisteroggend aan die verdediging gegee het. Minder mense as die vorige dag het gister by die landdroshof opgedaag. Die verrigtinge het omstreeks 09:30 begin nadat adv. Willem Coetzee en Stoffel de Jager vir die verdediging met die beskuldigde vergader het. Die beskuldigde het 'n wit-en-beige streeptrui en swart jeans gedra. Hy het gespanne gelyk en water uit 'n bottel gedrink nadat hy iets in vriende se oor gefluister het. Staatsadvokaat JJ Cloete het die verrigtinge begin deur te sê De Waal gaan 'n verklaring van 20 getikte bladsye voorlees. Hy wil ook drie foto-albums met getuienis voorlê om die borgaansoek teen te staan. Cloete het kapsie gemaak teen Coetzee se beskuldiging dat hy skielik die getuienis op hom gegooi (gedump) het. Die staat voer aan dat net soos hy nie geweet het wie die verdediging gaan roep as getuies nie, hy dit ook nie kan doen nie. Dit is reg as deel van sy strategiese beplanning. Cloete het wel De Waal se verklaring eergister beskikbaar gehad, maar wou eers die getuienis van die verdediging aanhoor voordat hy 'n besluit sou neem. Die saak is nog nie in die verhoor-fase nie en die verdediging het nie toegang tot die dossier nie. Dit sal die hof, landdros en getuienis verontrief as die saak tot Maandag uitgestel word soos die verdediging versoek het. Hy sal eerder voorstel dat die verdediging na sy getuienis luister en die naweek voorberei vir Maandag se kruisondervraging. Coetzee het gesê hy kon slegs vlugtig na die dokumente kyk. Hy moet dit eers deeglik bestudeer en hom van die feite en bewerings vergewis. Daar is ingewikkelde deskundige getuienis en verwysings. Hy wil besluit watter getuienis toelaatbaar is en watter nie sodat die minderjarige nie benadeel word nie. Voorbereiding sal hom help om deeglik te kruisondervra. Hy is bevrees sy kliënt word benadeel deur die gebrek aan tyd om die staat se getuienis te bestudeer. Dit kom voor of die staat nou reeds die hoofgetuienis van die verhoor aan die hof wil voorlê. Landdros Sipiwe Maswi het gesê die staat het wel die verdediging verras. Hy het Coetzee gevra of hy nie eerder dadelik na die dokumente wil kyk nie sodat hy kan besluit watter getuienis toelaatbaar is en sodat die getuienis kan voortgaan. Maswi kan nie sien hoekom die staat nie De Waal se getuienis kan aanbied nie. Die hof het daarna tot 11:00 verdaag. Hulle is op Goeie Vrydag in hul plaashuis doodgeskiet. Blykbaar is kruit op die seun se klere gevind en sy vingerafdrukke was op die twee wapens wat vermoedelik in die skietery gebruik is. Die polisie het op die uitslag van dié toetse gewag voordat hulle ’n inhegtenisneming kon doen. Die feit dat dit nou gebeur het, dui daarop dat die uitslag hom waarskynlik verbind met die skietdood van Deon (44) en Christel Steenkamp (43) en hul dogter, Marthella (14). Hulle is op 6 April op die plaas Naauwhoek, sowat 9 km buite die dorp, vermoor. Die egpaar se seun, Don, is die enigste oorlewende van die treurspel. Die Nasionale Vervolgingsgesag (NVG) het vroeër vandeesmaand gesê ’n besluit oor vervolging sal geneem word op grond van die getuienis wat die polisie ingesamel het. “Ons wil seker maak die saak is sterk genoeg om in die hof te staan. Die bewyse moet waterdig wees om suksesvolle vervolging te verseker.” Die seun is gister kort ná 09:00 by sy skool in hegtenis geneem. Kapt. Cherelle Ehlers, polisiewoordvoerder, het bevestig die Valke het gisteroggend ’n minderjarige in Bloemfontein in hegtenis geneem. Volgens die tiener se skoolhoof het die polisie hom gevra om die kind na sy kantoor te ontbied. “Hulle het hom toe in hegtenis geneem op drie klagte van moord.” Die seun is na die kantoor van die Valke in Kimberley gebring, waar lang samesprekings gevoer is tussen onder andere die polisie en sy regsverteenwoordigers. Die seun was ook teenwoordig. Stoffel de Jager, prokureur, en adv. Willem Coetzee, wat die minderjarige verteenwoordig, het sy inhegtenisneming onder andere met staatsadvokaat ­Tanya Birch en haar span bespreek. Hy sal nou Donderdag in die hof in Griekwastad verskyn en om borgtog aansoek doen. Hy het Don weer eergisteraand probeer bel, maar die seun het nie sy selfoon geantwoord nie. “Ons dink aan hom en sodra die skool Dinsdag begin, sal ons meer weet van die begrafnisreëlings, waarna die skool verdere reëlings sal tref.” Volsteedt sê net hy mag in sy hoedanigheid as skoolhoof inligting oor Don aan die media verskaf en nie personeel of leerlinge van dié skool nie. Strike at Gold Fields mine could hit whole sector

The workers have also threatened to mobilise their colleagues in other Gold Fields mines, heightening fears that industrial action could escalate in the mining sector. This comes after threats by desperate Aurora mineworkers, who have been without pay for four years, to shut down all Ekurhuleni mining operations from today. “We are not going to spare your life,” one of the miners’ leaders said during a visit by expelled ANC Youth Leader president Julius Malema to the mine on Thursday. Production at Gold Fields’s East Section was halted on Wednesday night when about 12 000 employees, including rock drillers and winch and locomotives operations, went on a wildcat strike. The strike was sparked by what the workers said was the illegal deduction of their state pension fund. The workers have, however, added an R11 000 wage demand to their grievances. Gold Fields, which is listed on the Johannesburg and New York stock exchanges, produces 3.5 million gold-equivalent ounces a year, according to its website. The company operates eight mines in Australia, Ghana, Peru and SA. Workers said they were surprised to find a R69 deduction on their salary slips last month. Alarmed, they had confronted their local leaders in the National Union of Mineworkers (NUM) and when they could not get a satisfactory explanation, they resolved to shut down the union’s branch office. This has again shone the spotlight on the NUM’s role following reports of fractured relationships between the union and its members at Lonmin’s Marikana platinum mine and other operations. However, the NUM’s rival, the Association of Mineworkers and Construction Union, has played no role at KDC East. The miners have chosen representatives from among themselves, shunning NUM branch leaders’ representation. More than 2 000 workers converged at around lunchtime yesterday on a hilltop that some jokingly refer to as Marikana, near the main shaft. Some had walked for about 5km from other shafts. Brandishing knobkierries and sticks, they moved around chanting revolutionary slogans and songs while waiting for their leaders to address them. The mine security guards watched from atop six police Casspirs, while some captured the procession on video camera. Among the striking miners was Siphiwe Msami, 52, a rock drill operator who has worked at the mine for 32 years. He earns a gross salary of R5 600 and is left with R4 600 after deductions. “We work so hard for nothing. I just survive on credit and it seems like I will owe until I die. Life is hard if you work in the mines, mfowethu (my brother),” said Msami, a father-of-six from Matatiele, KwaZulu-Natal.
