Die oomblik toe Samantha Bennett ná al die jare weer in die oë van haar pa se vermeende moordenaar kyk, sal haar altyd bybly.
Net soos daardie oomblik toe haar pa, Lee (46), twee dekades gelede reg langs haar op die inrit van hul huis in Parkmore, Sandton, met ’n enkele skoot in die kop doodgeskiet is.
Samantha (29), wat die afgelope week van Engeland gekom het om teen die vermeende kaper te getuig, was destyds ’n blonde sproetgesigmeisie van tien jaar oud.
Die dag ná haar roerende getuienis in die hooggeregshof in Johannesburg het sy in ’n openhartige onderhoud met Rapport vertel oor haar besluit om die verlede te konfronteer.
“Dit het my ’n bietjie siek laat voel toe ek hom sien, maar dit was goed op ’n manier, want ek was bekommerd hy gaan anders lyk en dat ek hom nie gaan onthou nie. Maar toe ek hom sien, het dit my dadelik teruggeneem na daardie aand,” sê sy.
“Ek het nooit die knal van die skoot vergeet nie, ek het nooit die reuk vergeet nie, nie my pa se bloed op my skoot óf al die glas nie . . .”
Die pa en dogter het die aand in hul blou Nissan Sani-4X4-bakkie van ­Samantha se gimnastiekklas teruggekeer. Toe hulle by hul inrit indraai, het die aanvallers toegeslaan.
Samantha vermoed hulle het nie besef daar is ’n kind in die voertuig nie.
“Toe kyk hy vir my. En ek kyk vir hom en toe skiet hy my pa,” het sy getuig oor die oomblik waarop haar lewe soos wat sy dit geken het, verpletter is.
Oudspeurders van die destydse Brixtonse moord-en-roofeenheid het ook die afgelope week getuig.


Ao. Billy Cox, wat Samantha se verklaring kort voor middernag in die Bennetts se huis afgeneem het, het selfs nog sy sakboekie met sy notas van destyds by hom in die hof gehad.
Oudbrig. Piet Byleveld het getuig hoe die jong Samantha sonder aarseling in 1996 vir Martin Ngema op ’n uitkenningsparade as haar pa se skieter uitgewys het.
Samantha se ma, Sally, het dieselfde jaar nog met Samantha en haar ouer broer na Engeland geïmmigreer om ’n nuwe lewe te bou.
Tot in 2013 het hulle geglo Ngema is in die tronk aan vigs dood.
Maar in werklikheid het hy in 1997 al uit die tronk ontsnap, kort voordat sy verhoor sou begin.
Die staat voer aan hy het ná sy ontsnapping sy eie doodsertifikaat vervals en sy identiteit verander.
“Wyle” Martin Nkosenye Ngema het glo “Alfred Sibusiso Ngema” geword.
In November 2013 het die polisie “Alfred Ngema” in Vryheid, KwaZulu-Natal op ’n klag van roekelose en nalatige bestuur aangekeer en ontdek sy vingerafdrukke stem ooreen met die van Martin Ngema wat destyds in die kapers se wegkommotor gevind is.
Ngema was teen dié tyd ’n suksesvolle motorverkoopsman.
Die nuus was ’n skok vir Sally Bennett en sy het maande gewag voordat sy haar kinders daarvan vertel het.
“Ek het net gedink, wat is die punt? Dit gaan nie hul pappa terugbring nie,” sê sy. Maar toe Samantha hoor sy kan in die hofsaak getuig, het sy dadelik ingestem.
“Ek wil hê hy moet tronk toe gaan. Hy verdien nie om ’n normale lewe met sy gesin te hê nie. Hy het ons ­lewens verwoes.”
 Ngema ontken skuld op aanklagte van moord, poging tot roof met verswarende omstandighede, die onwettige besit van ’n vuurwapen en ammunisie en die besit van gesteelde goe­dere.

Johannesburg High Court, Nov 2014: After 20 years a man suspected of killing Lee Bennett with a headshot in the driveway of Sandon Road Parkmore, has been found hiding under a fake identity. Martin Ngema (then 23) appeared in Johannesburg High court this week after he had been picked up as Alfred Sibusiso Ngema on a charge of reckless driving. When his fingerprints were taken, police realized they had the accused killer of Lee Bennett in custody. Just after the cold-blooded killing, Bennett's ten-year-old daughter Samantha didn't hesitate when she pointed out the man who killed her dead to detective Piet Byleveld. Ngema was discovered after he managed to have himself 'disappear' by creating a fake identity and falsifying a death certificate.
Ngema's fingerprints also were found in the red VW Golf with which he and two co-accused Johannes Matli and Nhlandhla Madia had fled after shooting the white Parkmore man.
Shortly before the trial in 1997 Ngema - suspected with the help of a police officer and a falsified signature - managed to escape from jail on 'bail' granted by a magistrate.
Then Ngema faked his own death-certificate and with a slight change in his identity number, obtained a new identity from the HOme Affairs department.
"The Late Martin Nkosenye Ngema' became "Alfred Sibusiso Ngema". In November 2013, his past caught up with him when he ws arrested for reckless driving.
And Ngema was only caught because his fake 'death' had never been registered in the SA Police records. 
His 'new life' was revealed: he had spent years learning salesmanship at a car-dealership in Vryheid - and even became salesman of the year several times.
He now is a director of the black-economic-empowerment company Indlela Yomnotho Trading and Projects and contracts his services to the eThekwini-municipality.
He also purchased several properties in town. His manager vehemently denied that the man arrested by the police could possibly have been a killer. 'Not Alfred. He's a great, open-hearted guy, ' said his manager. In his view it was simply 'unthinkable' that Ngema was one of the three blacks who attacked Lee Bennett and his ten-year-old-daughter 20 years ago...

After nearly 20 years, a murder suspect, who astoundingly manoeuvred himself into a brand new life has finally been brought to book. Samantha Bennett was barely ten years old when, in 1995, a male detective Piet Byleveld had to be appointed after her father, Lee (46), lay next to her in cold blood in an alleged murder. The little girl showed no hesitation when identifying Martin Ngema (then 23) as the one who had shot her father, Lee Bennett in the head on November 21,1995 at their home Shandonweg, Parkmore in Johannesburg. Ngema's fingerprints were also found in the red Volkswagen Golf that he and his two alleged accomplices, John Matli and Nhlanhla Madia fled the scene with. Unlike his alleged accomplices Ngema refused bail. Shortly before the trial in 1997, Ngema, presumably with the help of a policeman and the forged signature of a magistrate escaped from prison "on bail". Ngema then forged his own death certificate and forged a new ID with a small adjustment in his identification number from the Department of Home Affairs. The "late" Martin Nkosenye Ngema became Alfred Sibusiso Ngema. Ngema was well known in Vryheid and had built fairly good relationships with many locals as a salesman at a local car dealership. He had won the "Salesman of the year" award a few times as he was said to be one of the best at doing his job. He was among the eThekwini Municipalities client list as the director of the company Indlela Yomnotho Trading. He had also purchased several properties in town. His past caught up with him in November last year when the traffic police arrested him and he was charged with reckless and negligent driving. When his fingerprints were taken, the police realised he was the alleged killer of Lee Bennett. Ngema who recently visited the Johannesburg High Court, was arrested because his "death" was never recorded on the police system. Ngema's manager is said to have adamantly defended him after police arrested him. "I told them it could not be. Not Alfred. He is a great, candid guy, "the manager told the Rapport. It seemed inconceivable to the manager that Ngema had been one of the three who attacked Samantha and Lee back in 1995.

IT WAS ONLY THEN THAT IT WAS ESTABLISHED THAT HE HAD ASSUMED A

NEW NAME AND WAS WANTED FOR THIS MURDER IN 1995 ON LEE BENNETT.

IT TOOK DEDICATED MEMBERS OF THE SOUTH AFRICAN POLICE AND EX

POLICE MEMBERS TO RECONSTRUCT THE CASE DOCKET (WHICH HAD BEEN DESTROYED) AND PRESENT IT FOR TRIAL.

Pillay faces criminal charges after SARS spies explosive confession

Former SARS deputy commissioner Ivan Pillay faces a string of criminal charges after two members of the tax authority's disgraced rogue unit submitted explosive affidavits to the Hawks implicating him in the illegal bugging of the National Prosecuting Authority offices.

Pillay stands accused of authorising an illegal operation in 2007, code-named Project Sunday Evenings, to spy on former prosecutions boss Vusi Pikoli and other senior NPA members who were investigating former police commissioner Jackie Selebi.
Affidavits by two former rogue-unit members, Helgard Lombard and Johan de Waal, submitted to the Hawks investigators on Thursday and seen by the Sunday Times, also implicate senior prosecutors and former Scorpions officials Gerrie Nel and Andrew Leask in paying R900, 000 for the bugging equipment.
Nel is South Africa's most celebrated prosecutor, with a string of high-profile convictions under his belt, including those of Selebi and Paralympian Oscar Pistorius.
The exact motives for the South African Revenue Service to spy on the NPA remain unclear, but in an affidavit former rogue unit head Andries Janse van Rensburg says he wanted the group to "have the power to decide who will next govern South Africa".
Van Rensburg, a former intelligence operative nicknamed Skollie, also wanted the unit to "execute a coup by deciding to whom the group are going to give the evidence we got from the DSO [the Directorate of Special Operations, or Scorpions] monitoring operation".
Lombard and De Waal's affidavits reveal the SARS agents secretly installed audiovisual bugging devices in 12 NPA offices and boardrooms at the NPA headquarters in Pretoria, including Pikoli's.
SARS spokesman Luther Lebelo said the tax authority was "deeply shocked" at the latest allegations but declined to comment until investigations into the rogue unit by audit firm KMPG and senior counsel were completed.
"It will be inappropriate for SARS to comment before receiving and studying this report," he said.
Documents seen by the Sunday Times include a legal opinion about Project Sunday Evenings by law firm Mashiane Moodley and Monama that was submitted to SARS commissioner Tom Moyane this week.
It says Moyane is legally obliged to institute criminal charges against Pillay, Van Rensburg, Lombard and De Waal for corruption, money laundering, racketeering and conducting covert intelligence on the NPA. Failure to do so would itself amount to a criminal offence.
Lombard and De Waal, who still work for SARS, confessed in March that they had spied on the NPA on instructions from Pillay and Van Rensburg. This was after they were confronted with evidence found on computers seized by investigators from KPMG.
Moyane appointed KPMG to probe the rogue unit earlier this year after a panel led by advocate Muzi Sikhakhane and an advisory board headed by retired Judge Frank Kroon found its establishment was illegal and it had committed unlawful acts. The KPMG investigation is expected to be wrapped up next month.
"It is known amongst the investigating team that both Mr De Waal and Mr Lombard have already confessed to the commissioner with regard to their role in the spying of the NPA," the legal opinion states.
Moyane caved in to political pressure earlier this month and let Pillay quit with a golden handshake shortly before his disciplinary hearing was scheduled to begin.
In his affidavit submitted to the Hawks this week, Lombard says he and De Waal decided to spill the beans to Moyane, adding: "I am no longer going to keep it secret because it will damage the image of SARS should it leak out."
Lombard outlines how Van Rensburg had asked him in April 2007 about the feasibility of planting bugs in the NPA offices. Lombard had replied it would be difficult but not impossible if legally authorised.
Van Rensburg then claimed he was contacted "out of the blue" in June by Nel and Leask, who asked him for help in securing the NPA offices against infiltration by crime intelligence officials wanting to sabotage the Scorpions case against Selebi.

The Scorpions paid Lombard two tranches in cash of R900, 000 and R250, 000 to buy the surveillance equipment, which he installed together with Van Rensburg in July.
It included "overt and concealed cameras with digital video recorders and microphones" that could be activated remotely and "remote viewing software to be used with cellular telephones".
Then, in September 2007, as political tensions around the Selebi investigation escalated, Van Rensburg tasked him with accessing recordings of any discussions related to the police chief's case. He continued to do so for several months.
"As far as I can remember, I only monitored and gave information regarding the case of commissioner Jackie Selebi through to Skollie and ignored other non-related discussions," he said.
Lombard said Van Rensburg had claimed they were spying on the NPA with legal authorisation and the approval of former president Thabo Mbeki because he wanted to keep tabs on the Scorpions investigation into Selebi, but that this was a lie.
When Lombard informed Pillay he was uncomfortable with the operation, the deputy commissioner told him to "carry on with the monitoring unless it is unsafe to do so. At no time Mr Ivan Pillay told me to stop the operation," he said.
Pillay denied Mbeki had approved the project and said that he would take full responsibility for it. "Mr Pillay said that if I ever was confronted with this operation he would say that he [Pillay] gave the instruction."
SARS sources said the reason for planting bugs at the NPA offices was to help the Scorpions investigators who wanted to keep tabs on deliberations by their managers handling the Selebi case.

The SARS leadership at the time was at war with Selebi because he wanted the police to take over the tax authority's border-control functions, the sources said.
Selebi had angered the Scorpions when he called for the elite crime-fighting unit to be collapsed into the South African Police Service, accusing its members of encroaching on the police's arrest mandate and of manipulating evidence to boost their success rate.
Police arrested several Scorpions members for corruption on Selebi's watch, including Nel. The charges against Nel were later withdrawn.
Selebi was convicted of corruption in 2010 and died earlier this year while on medical parole.
SARS's clandestine spying operation on the NPA was code-named Project Sunday Evenings because Lombard would "dial in from his home every Sunday evening to listen to week-long discussions in the NPA offices", said a source close to the investigation.
SARS requested this week's legal opinion after it received media queries from the Sunday Times.
This prompted Moyane to prepare a statement to be submitted to the Hawks recommending the rogue agents be charged with corruption, money laundering, racketeering and conducting covert intelligence on the NPA, according to sources familiar with the case.
The legal opinion confirms Lombard received R900, 000 to buy bugging equipment. He spent only R800, 000 and was told to pocket the rest.
This R100, 000 payment constituted a bribe in terms of the Prevention and Combating of Corrupt Activities Act carrying a maximum prison term up 10 years in jail, the law firm said.
"Once the criminal case has been opened it is up to Mr De Waal [and] Mr Lombard to become state witnesses against Mr Pillay."
The law firm said the spying allegations were "intertwined and inseparable from the R100000 gratuity given to Mr Lombard", adding: "The allegation if proven amounts to a serious criminal offence. SARS does not possess the legal mandate to conduct intelligence."
Yesterday, NPA spokesman Velekhaya Mgobhozi sounded surprised when contacted for comment on the bugging of the prosecuting authority's headquarters and allegations that Nel and Leask had bankrolled SARS rogue-unit members to do so.
"Gerrie Nel and Andrew Leask gave someone money to buy bugging equipments? I know nothing about that. The NPA has got no comment on the subject you are raising," Mgobhozi said.
Pillay said: "I cannot comment."
