Despite mounting legal costs, the Opposition to Urban Tolling Alliance (Outa) is adamant that the merits of their case and its importance for society warrant pursuing it.
The alliance’s ability to fund their appeal has a become a focal point, with Outa already R3m short on their own R10.8m legal bill, while being ordered to also pay for three opposing counsel when they lost the judicial review in December last year.
Prof Warren Freedman, associate professor at the University of KwaZulu-Natal School of Law yesterday said: “A court may grant leave to appeal subject to the applicant (Outa) being ordered to provide security for the costs of the appeal.”
While Sanral yesterday refused to comment on the matter, Outa chairperson Wayne Duvenage confirmed that as the application to appeal is still being considered, Sanral has not yet approached them to provide such security.

OUTA have been informed that their application seeking leave to appeal the eToll judgement passed down by Acting Judge Louis Vorster in December 2012, will be heard in the North Gauteng High Court on Friday 25th January 2013.
OUTA’s decision to apply for leave to appeal was taken after serious consideration of the judgement, wherein we believe the judgment was seriously flawed and in particular, the costs order against OUTA was unnecessarily onerous.
OUTA remains committed to this case, which largely seeks to protect citizen’s constitutional rights, along with challenging the onerous, expensive, inefficient and cumbersome matters related to the decision to toll Gauteng’s freeways. OUTA again calls for the e-Toll recommendations made by the Inter Ministerial Committee (IMC) to cabinet, to me made public.
OUTA is actively pursuing the raising of funds to successfully conclude this matter. Without the necessary funds, our position is weaker and we urge the public and business to continue supporting us now more than ever. We are heartened by the fact that society has helped us raise R8 million to date, however, we are still R2,5 million short to cover current costs and still require an estimated R1,5 million for the appeal process. In this regard, we urge the public to go to the OUTA web site (www.outa.co.za) to make their contribution easily and securely.

According to a press statement by Wayne Duvenhage, opposition to urban tolling alliance (Outa) chairperson, the application seeking leave to appeal the e-Toll judgement passed down by acting Judge Louis Vorster in December 2012 will be heard in the North Gauteng High Court on Friday 25 January.

This is not a matter of costs to Outa.
This is a matter of what our Democracy really costs the man in the street.
This whole process was flawed and should be "SCRAPPED!"
The appeal will be heard on Friday 25 Jan 2013 in the NORTH GAUTENG High Court.
WE WISH OUTA ALL THE SUCCESS IN THE DEMOCRATIC WORLD.
The ANC and their cronies are responsible for this financial blunder and should be held accountable!
