Suspended National Prosecuting Authority (NPA) prosecutor Glynnis Breytenbach will apply to the Bargaining Council in Centurion on Tuesday for the overturning of her eight-month suspension.
Breytenbach was suspended as regional head of the NPA's specialised commercial crime unit on April 30.
She has argued that acting National Director of Public Prosecutions Nomgcobo Jiba suspended her to try and stop her from prosecuting former police crime intelligence boss Richard Mdluli on fraud and other charges.
Breytenbach has pleaded not guilty to all 16 charges brought against her by the NPA.
Her internal disciplinary hearing is set to resume next year.
It will be chaired by advocate Selby Mbenenge, who was appointed three weeks ago after Sandile July recused himself.
