They had not been ordinary criminals who committed crimes for gain, but "soldiers in a liberation struggle" and embroiled in a war, three brothers charged in the Boeremag trial say in their application to be declared prisoners of war.

The application was filed at the Pretoria High Court on Wednesday, but is to be heard next Wednesday. The State is to oppose it.

Brothers Johan, Wilhelm and Pretorius said they had not been embroiled in a plot to overthrow the government but to further the aims of the Boerevolk in their struggle for self-determination.

They are calling on Judge Eben Jordaan to afford them protection under the Geneva Convention and Protocols.

The brothers claimed that they held ranks in the "war" and acknowledged they had participated in several of the activities of which the State accused them.

Johan Pretorius said he, like his brothers, acknowledge their involvement in such activities as making home-made bombs, knowing these bombs were to be placed at strategic points.

"But I at all times regarded myself as a soldier of the South African Boere Republic who was in a war situation," he said.

"There never was any mention of a coup, but rather an armed conflict that followed a declaration of war."

If the trio were declared prisoners of war, they will be handed over to the SA National Defence Force.
